A judge last week ordered Detroit Emergency Manager Kevyn Orr, the state budget director and another state official to be deposed in a lawsuit contesting Orr’s appointment.
The lawsuit, filed by Detroit activist Robert Davis, who has gone to court to challenge the emergency management status of Detroit and other Michigan cities, argues that Orr’s appointment violated the state’s Open Meetings Act.
Ingham County Circuit Court Judge William Collette last week ordered Orr and two of the three members of the state’s three-member emergency loan board, which hires emergency managers, sit for depositions. The judge also ordered the men to provide email, memos and other documents related to Orr’s appointment. The board members include state budget director John Nixon and Steve Arwood, the director of the Department of Licensing and Regulatory Affairs. The third board member, state Treasurer Andy Dillon, is not required to testify.
