Rhode Island Judge Williams to Mediate 38 Studios Case

Retired Rhode Island Superior Court Judge Frank Williams was named mediator in the lawsuit by a state agency against now-defunct video game company 38 Studios.

Superior Court Judge Michael Silverstein has ordered the parties into mediation "as soon as is practicable" after May 29, according to a court order.

Rhode Island Commerce Corp., formerly the Rhode Island Economic Development Corp., sued former Boston Red Sox pitcher Curt Schilling and other parties over a $75 million loan the agency issued in 2010. The state backed the bonds with a moral-obligation guarantee. The company folded two years later.

The lawsuit alleges fraud, negligence and breach of fiduciary duty.

Williams in April brokered an agreement in a lawsuit by several public-sector unions challenging the 2011 law that overhauled the state's pension benefit system. Superior Court Judge Sarah Taft-Carter has held so-called fairness hearings on the compromise the past week.
