DiNapoli Releases Cap Report

About 18% of New York localities are seeking to override a property tax cap in the current fiscal year. State Comptroller Thomas DiNapoli reported the figure in a report on the tax cap on Wednesday.

In 2011 state government passed a property tax cap. This affects all local governments, most school districts except New York City, and many other tax districts like those for libraries, fire and water.

The property tax levy is capped at 2% or the inflation rate, whichever is less, with some exceptions.

Local governments can vote to override the cap.

DiNapoli reported that 32% of the counties, 30% of the cities, 29% of the towns and 3% of the school districts, and 15% of the fire districts plan to override the cap.

Of the 61 cities in New York, excluding New York City, 48 had to file their plans by the time of DiNapoli's release. Of the 48, 46 actually filed on time.

While all the counties filed their plans, 7.1% of the towns, 0.6% of the school districts, and 10.9% of the fire districts failed to file their plans as required.
