San Bernardino Voters Recall City Attorney Penman and a Council Member

Bankrupt San Bernardino, Calif., saw two elected officials recalled in a hotly contested election Tuesday.

Departing the scene will be City Attorney Jim Penman, a major figure in the city's bankruptcy case. About 60% of voters favored his removal from office, and he will be replaced by real estate attorney Gary Saenz.

The news was mixed for Councilwoman Wendy McCammack. She lost the recall vote for her council seat, but garnered the most votes in the mayor's race, and will face accountant Carey Davis in a February run-off.

Incumbent Mayor Pat Morris decided not to run for a third term.

Election night unofficial results show McCammack ahead by 136 votes in the mayor's race that drew 10 candidates.

McCammack was one of three elected officials facing recall. Councilman John Valdivia retained his seat.

Chas Kelley, a 10-year councilman and the front-runner for mayor, resigned his seat and dropped out of the race after pleading guilty to perjury on charges that he misspent campaign funds and filed a false report. Charges were brought against Kelley the same day that Councilman Robert Jenkins was charged with multiple counts of identity theft and stalking.

Benito Barrios beat Jenkins in his city council race by 104 votes.
