Appeals Court Overturns Ruling on Detroit EM Lawsuit

The Michigan Court of Appeals Friday blocked an Ingham County judge's order that an aide to Gov. Rick Snyder turn over the names of all candidates for the Detroit emergency manager position.

The three-judge court halted hearings and depositions in the lawsuit, filed by Detroit activist Robert Davis, which says Detroit EM Kevyn Orr's appointment was illegal because it violated the Open Meetings Act. The appellate court also said that an aide to Snyder did not have to turn over all emails related to the appointment.

Earlier in the week, Ingham County Circuit Court Judge William Collette had ordered the aide, Rich Baird, to give the names of all the candidates considered for the job.

"Pending further order of this court, the trial court shall take no further action in this case including, without limitation, the holding of hearings and the scheduling or taking of depositions," the appeals court judges wrote in an opinion released Friday night.

Last month, the appellate court halted Collette's order that Orr and members of the state's emergency loan board be deposed.
