The Michigan Supreme Court may consider a lawsuit that seeks to remove the emergency manager of Detroit Public Schools after voters overturned the state’s emergency management law Nov. 6.
The Michigan Court of Appeals last Friday upheld the state’s current EM law, keeping DPS manager Roy Roberts and five other managers in their positions.
The Detroit-area activist who filed the lawsuit seeking Roberts’ ouster said Monday that he had filed an emergency request with the state Supreme Court asking it to take the case.
Voters on Nov. 6 repealed the controversial 2011 law managing distressed local governments. The law, Public Act 4, has been suspended since August, when the state elections board approved the repeal referendum for the ballot.
In the law’s absence, the state revived its old law, Public Act 72. That law faces its own challenges from opponents who argue that the revival is illegal. A hearing on that challenge is expected in early December.
