Health Care Back & Forth

U.S. attorneys last week filed a motion to dismiss the federal lawsuit filed in March by Florida Attorney General Bill McCollum challenging the massive health care reform bill.

A 79-page memorandum supporting the motion said that claims made by the suit run "afoul of consistent Supreme Court precedent" and that plaintiffs have no standing to bring their case.

"Nothing in the Justice Department's motion … changes the states' view that we will prevail," McCollum said in response to the dismissal motion. "Our lawsuit challenges the individual mandate that violates the U.S. Constitution."

The original lawsuit was filed with 13 states and was later amended to add seven additional states, the National Federation of Independent Business, and two individual plaintiffs.
