Hearing Today in Jefferson Co. Sewer Case

U.S. District Judge R. David Proctor today holds a second conference call with attorneys for Jefferson County, Ala., and the bond insurers and trustee who are seeking immediate appointment of a receiver for its troubled sewer system.

Proctor said after his first conference call Friday that he would schedule a “two-day settlement summit” regarding the lawsuit and he directed attorneys to “cooperate in making anyone whom the parties believe could materially affect a resolution of this matter” aware of today’s conference call.

When asked for a comment, County Commission president Bettye Fine Collins’ office said the judge did not want to see any comments related to the case published in the media.

The federal suit was filed Sept. 16 by the trustee, Bank of New York Mellon, and Financial Guaranty Insurance Co. and Syncora Guarantee Inc. In their response, county commissioners said appointing a receiver could force them into bankruptcy.
